Civil litigation is the process in which civil matters are resolved in a court of law. Civil matters can be described as situations dealing with relationships between people, such as a marriage, or a contract dispute between corporations. Rather than a case being a person versus the government, as in a criminal matter, civil cases are an individual or business filing suit against another individual or business.

Types of civil litigation cases:

 

  • Breach of contract and contract litigation

  • Landlord-tenant disputes or property disputes

Standard of proof in civil cases:


Unlike in criminal cases where the standard of proof is “beyond a reasonable doubt,” which is the highest standard recognized under the law, the burden of proof in civil cases is called “preponderance of the evidence.” In other words, you need to prove that that your story is probably more true ore more convincing than your opponent’s story. In some cases, the standard elevates to what is called “clear and convincing evidence.” This means that in order to win, you must prove that your version of the facts is highly likely.
